Sweeping Changes to AE Work Visas: Impact on Employers and Migrant Employees
Changes for AEWV Holders
Duration of Stay:
If you applied for your first AEWV before 21 June 2023 and are in an ANZSCO level 4 or 5 job with the required wage rate, your maximum stay is now reduced. You will no longer access the maximum five years; current holders of a three-year AEWV will be affected.
Those in ANZSCO level 4 or 5 jobs on a pathway to residence are not impacted by this change.
For AEWV applications on or after 7 April 2024, updated criteria must be met. ANZSCO level 4 or 5 job holders might not stay and work for the full five years.
New Minimum Skill Requirement:
Applicants must now show work experience or qualifications beyond those identified by the employer.
Exemptions apply to roles on the Green List meeting Green List requirements or those paid at least twice the median wage.
Evidence required includes:
At least 3 years of relevant work experience, or
A relevant qualification at level 4 or above on the NZQCF.
Qualifications below a Bachelor’s degree level need an International Qualification Assessment (IQA).
Proof of genuine work experience is mandatory.
Minimum Standard of English:
ANZSCO level 4 or 5 job applicants must demonstrate English proficiency.
This does not apply to current applications or partners/children of AEWV applicants.
Shorter Visa Length and Stay:
Maximum visa length for ANZSCO level 4 or 5 jobs paying the required wage rate is now 2 years, extendable by one more year with a new Job Check.
The total maximum continuous stay on one or more AEWVs is reduced to 3 years. After reaching this limit, you must leave New Zealand for typically 12 months before reapplying.
These changes apply to first AEWV applications on or after 7 April 2024 or before 21 June 2023.
Exemptions:
Certain ANZSCO level 4 or 5 jobs are exempt from these changes, including:
Green List roles,
Roles in transport and care sector agreements on a residence pathway,
Jobs earning 1.5 times the median wage.
ANZSCO level 1 to 3 jobs maintain a 5-year visa length and maximum continuous stay.
Changes for Employers
Accreditation and Job Check Requirements:
Increased requirements during accreditation, Job Check stages, and throughout the accreditation period.
Employers must provide a minimum of 30 hours of work.
Higher Applicant Requirements:
Stricter work experience and qualification requirements for AEWV applicants.
English proficiency standard for ANZSCO level 4 and 5 roles.
Shorter Stay for Specific Roles:
Reduced visa lengths and continuous stay limits for certain roles.
Operational Requirements:
Advertise job vacancies for 21 days instead of 14.
Engage with Work and Income.
Declare why any New Zealand applicants were not hired in the Job Check.
Notify INZ within 10 days if a migrant employee leaves.
Compliance:
Suspension of Accreditation can occur under more circumstances.
ANZSCO classification is reinstated for work roles.
